St. Louis Bar under Scrutiny for Tent Stability after Fatal Accident outside Busch Stadium

in Safety Issues

One person was killed and 17 suffered serious injuries in a freak accident in St. Louis, MO. over the weekend. A storm blew into the St. Louis area and the strong winds caused several tents to blow over outside Busch Stadium, where people were partying and drinking beer.

The accident happened following the Cardinals game against the Milwaukee Brewers on Saturday at tents set up outside Kilroy’s Sports Bar.

The St. Louis city building commissioner said the bar was granted permission to put up the tents at baseball games and had been inspected to ensure safety. There is a question of safety though because the tents are supposed to be able to withstand winds of 90 mph and the winds during the storm on Saturday only got up to about 50 mph.

The accident will be investigated to determine if the owners of the bar are responsible for the accident in which several people suffered electrocution injuries and one person was fatally injured.

If you or someone you love has suffered a serious injury in an accident in Kansas or Missouri, you may be entitled to compensation for your losses including medical bills, lost wages and legal fees.  Don’t face the insurance companies alone.  Contact Kansas City Accident Injury Attorneys.  With over 15 years of experience in Personal Injury Accident cases we may be able to help your family.

Propane Tank Malfunctions can Cause Serious even Fatal Injury in Kansas and Missouri

in Safety Issues

At Kansas City Accident Injury Attorneys we know that accidents can happen at anytime.  With spring and summer upon us, more and more people are going to be heading out for weekend camping trips. A couple in their 60′s were seriously injured when they suffered severe burn injuries after a propane tank exploded while they were camping in Lebanon, Maine over the weekend. The couple, reported to be from Missouri, were each taken to hospitals for treatment for severe burn injuries. Witnesses say the explosion could be felt nearly ten miles away.

The explosion caused another propane tank to explode and also destroyed two campers that were parked at the campground. So far no one else has reported any injuries in the tank explosion. The Maine state fire marshall is investigating the cause of the propane tank explosion.

Our Kansas City Accident Injury Lawyers would like to remind to be safe when setting our on your family camping adventures.  Be sure to inspect your equipment each time you use it. If you see or know of anything that could lead to a malfunction or a safety violation, do not use it and have it fixed or replaced immediately. Here are some valuable safety tips to keep in mind when setting up a propane tank:

  • Never modify your propane system yourself. Modifications should be handled by authorized personnel only. Tampering with the system may cause a potentially dangerous situation.
  • If the scent of propane is in the air, a potentially dangerous situation may exist.
  • Extinguish all open flames, and immediately leave any area where propane fumes are present.
  • Avoid touching electrical switches or appliances when a leak is suspected.
  • In case of a leak, go to your propane system’s storage vessel, open the tank hood, and close the vapor service valve.
  • Always contact a qualified technician for assistance.

Remember, electronic leak detectors are available. Contact your nearest propane retailer for the purchase of a detector.

Kansas City Drunk Drivers Beware; Police Cracking Down to Counter Alarming Rise in Stats

in Drinking & Driving

At Kansas City Accident Injury Attorneys, we know how vital it is for state legislation to tighten grip on drunk drivers. The only way to get the point across about how dangerous and costly drunk driving can be, is to increase punishments for all offenders, even first time offenses.

This past weekend, a DUI checkpoint administered by Kansas City Police on Saturday March 31, 2012 netted at least 10 arrests. KC police stopped close to 200 vehicles over a five-hour period at south 13th and Pennsylvania Avenue in Kansas City, Missouri.

According to the NHTSA, 63 percent of the 21,798 drivers who were killed in motor vehicle crashes in 2009 were tested for drugs– of these, 3,952 tested positive for drug involvement, representing 18 percent of the total for that year.

In addition, data from individual states showed that drug use among fatally injured drivers increased from 13 percent in 2005, to 15 percent in 2006, 16 percent in 2007, and 18 percent in 2008.

Our experienced Kansas City Drunk Driving Injury Attorneys understand that it is important to offer a second chance. A one time mistake can be isolated. The real problem is the multiple offending drunk drivers. However, it’s also important to deter these dangersous driving habits to happen at all. There has bee some speculation that some states may turn to installing breathalyzers in all first time offender’s vehicles.

Look, we know from time to time people like to go out and have a good time– but please be responsible.  Your idea of too much too drink may be different from state law.  Even though you may think you are okay to drive, but one fatal mistake on the road could mean the loss of your life or someone else if you are involved in an accident.  Plan ahead.  Think smart and arrive alive.

If you or a loved one has been the victim of serious injury in a car accident involving a drunk driver you may be entitled to compensation for your losses.  Don’t delay, call our experienced Kansas City Personal Injury Lawyers.  With over 15 years of experience in Auto Injury Accidents and Drinking and Driving Injury Accident cases, we may be able to help you and your family determine the best way to proceed with your personal injury claim.

Who is to Blame for Drunk Driving Accidents in Kansas City?

in Drinking & Driving

How many times have you had a few drinks and gotten behind the wheel of your car thinking you have only consumed a few drinks and you’ve only got a few blocks to get home.  Maybe you’ve already had a DUI and maybe you should have gotten one by now.  If you do get one, who is to blame? Your friend for letting you drive? The bartender who served you? The old man at the liquor store who sold you the case of beer and bottle of Crown Royal? That’s the question presented in this story:

A restaurant in Charleston, SC is being sued for partial responsibility in the death of a 32 year-old man, killed in a drunk driving accident. The lawsuit has been filed claiming the popular restaurant, The Husk, continued to serve alcohol to Adam Burnell on December 16, 2011 just hours before Burrell was involved in a rear end collision that killed Quentin Miller.

Some counties in Kansas and Missouri are pushing for stricter punishments for repeat offenders and well they should.  The only thing that is worse than someone who makes the mistake of drinking and driving is someone that can’t seem to learn from that mistake.  One DUI is too many.  Getting three or four, or seven as in the case of Matthews, is just blatantly showing no concern for others.

As Kansas City Auto Accident and Injury Lawyers we are in full support of the continued push for larger fines and increased jail times in counties across Kansas and Missouri, but its important to keep in perspective just who is responsible for drinking and driving. Ultimately it comes down to the individual. We can point fingers all the way back to the makers of the beer or alcohol or to the bottlers or farmers who harvest the barley and grains but we all know that we each are responsible for our decisions, good or bad.

If you or someone you love has suffered a serious injury in a motorcycle accident in Kansas or Missouri, you may be entitled to compensation for your losses, including lost wages and medical bills.  But don’t try and take on the insurance companies alone.  Contact the experienced Kansas City Personal Injury Lawyersof Roswold Law Group.  With over 15 years of experience in Drunk Driving Injury Accident and Motorcycle Injury Accident cases, we can help you and your family determine the best way to proceed with your claim.  Call our office today to set up your free consultation.

A Kansas City woman was severely injured in a pedestrian accident involving a drunk driver over the weekend. The drunk driving-pedestrian accident happened at the 3700 block of Main in Kansas Ctiy Missouri on Saturday March 10, 2012. Police took the driver of the hit and run accident into custody under suspicion of driving while intoxicated.

Drinking and Driving in Kansas is never a good idea.  More likely than not, something bad is going to come of it.  Best case scenario, you get arrested, possibly serve jail time and at least over $1000 in fines and legal fees.  Worst case scenario, you cause a serious auto crash, seriously injure someone or even kill them or yourself.  The choice is yours.

Know the Rules of the Road: Pedestrians at Risk of Hit-and-Run Injury in Kansas City

in Auto Accidents, Pedestrian Accidents

Pedestrians of all ages are at risk for serious injury in an accident involving an car, if you’re not paying attention.

At KCAIA, we want you to be safe from injury. Here are some facts to consider:

  • 76% of all pedestrian fatalities occur away from intersections and crosswalks.
  • 83% of child pedestrian deaths occur at non-intersection locations.
  • Just over a third of children that are victims of pedestrian related accidents occur between 3 p.m. to 7 p.m. when they are known to be walking home from school and frequently playing outdoors in neighborhood streets.
  • One-fifth of children killed in traffic accidents were pedestrians.
  • Weather is not to blame as 90% of pedestrian fatalities occur in clear weather conditions.
  • Nearly 50% of older adult pedestrian related accidents happen when they have fallen in the road in the crosswalk or have fallen at the curb and then get struck by a car.
  • Throughout the year nearly 50% of pedestrian related accidents are alcohol related with New Year’s Day oddly being the day when most pedestrians are struck by vehicles where the incident involved either an intoxicated driver or pedestrian.

The police may be able to find fault in a pedestrian-auto accident but the truth is both motorists and pedestrians share responsibility.  Pedestrians should always follow proper safety guidelines the same as motorists should be aware of possible pedestrian activity.

As Kansas and Missouri Auto Accident and Injury Attorneys, we see these kinds of accidents far too often, so we want to give you a few tips on pedestrian safety including crossing streets at night.

  • Always cross at a designated crosswalk or at the corner of an intersection.  It might be a little out of your way, but cars are more likely to be alert of people crossing at corners.
  • LOOK BOTH WAYS.  Never assume a car is paying attention to you.  Be in control of the situation.  When in doubt wait for a car to pass before you cross.
  • If you’re out walking at night, wear bright colors.  BE SEEN.

Hearing Impaired Victims Injured in Olathe, Kansas Pedestrian Accident

in Auto Accidents, Pedestrian Accidents

Slow down. That’s the best advice we can give to motorists driving through areas with pedestrian crossings, especially if you’re in an area that has special crosswalks designated for hearing or sight impaired pedestrians. Take a situation that happened this week in the Kansas City metro area. Three hearing impaired victims were injured when they were hit by a car trying to cross a street in Olathe, Ks. Police say the driver didn’t see the pedestrians and they were not using a properly designated pedestrian crossing.

As experienced Kansas and Missouri Pedestrian Injury Attorneys, we deal with these cases on a day to day basis. Pedestrian accidents are unfortunately far too common in our good city. The causes for them range pretty drastically but one thing that can be for certain in any pedestrian accident is that no matter which party is at fault— someone wasn’t paying attention.

Pedestrians, should always use designated crosswalks that are clearly marked for motorists to see. The rules of the road say cars should always stop and wait for a pedestrian to cross but sadly this isn’t the case. Always look both ways and double check your self before crossing. That motorist may not be paying attention. If a crosswalk isn’t present, cross at the street corner.

Motorists should always be paying attention to the road no matter what. Put your cell phone away and stop messing with your radio. Unexpected things happen all the time and you need to be able to react if and when something happens.

If you or a loved one has been seriously injured in a pedestrian accident in Kansas or Missouri, you and your family may be entitled to compensation for your losses. Inattentive Driving May Cause Injury Accidents at Railroad Crossings in Kansas and Missouri

in Auto Accidents, Train Accident

At Kansas City Accident Injury Attorneys, we know things happen on the road while you’re driving that you can never predict and really maybe never plan for. Sometimes you just don’t know when or where your car is going to break down and it usually doesn’t happen in the most convenient of places. One of the worst places has to be on a train track. Yikes.

Last week, a car stalled on a railroad crossing near Miami in Broward County was hit by an approaching train injuring at least ten people aboard the train. The driver and passengers of the stalled car were able to get to safety, thankfully. Many people were injured and treated. Ten were taken to a nearby hospital for further evaluation. No injuries are expected to be life threatening.

Broward County deputies are investigating the crash, including trying to find out why the car stalled on the railroad track, causing the serious injury accident.

Our experienced Kansas City Personal Injury Attorneys want you to be safe while you’re out driving and one of the trickiest thing to do is cross a train track. Not all crossings have marked signals and crossing arms to let you know when a train is coming. That’s why it is important to:

  • STOP
  • LOOK
  • and LISTEN

Never try and beat a train across the track. Chances are you aren’t going to be able to judge the speed of the train. Those bad boys are moving a lot faster than you realize.Contact Kansas City Accident Injury Attorneys if you’ve been seriously injured in an accident in Kansas or Missouri.
